ENSP welcomes the European Court of Justice rejection of challenges against the Tobacco Products Directive

On 4 May 2016 the European Court of Justice rejected all three challenges brought forward by the tobacco industry against the Tobacco Products Directive (TPD).

ENSP welcomes the decision, which according to ENSP General Secretary Cornel Radu-Loghin " enables countries to adopt standardised packaging by clarifying that Member States may go further than the requirements set out in the Directive. This measure has strong evidence of effectiveness in preventing the uptake of tobacco use especially among young people.”

Second meeting of the expert group to review reporting arrangements under the WHO FCTC in Geneva, Switzerland
The expert group to review reporting arrangements under the WHO FCTC met in Geneva, Switzerland on 10-13 May 2016. The 9 Parties, 6 NGOs, the Sustainable Measures working group, WHO & Convention Secretariat present discussed the evolution and future development of FCTC reporting instruments.

European Regional Meeting on the Implementation of the WHO FCTC in Ashgabat, Turkmenistan

On April 28-29, the WHO Regional Office for Europe held its first regional gathering after the Roadmap of actions 2015-2025 was adopted by all Member States at the Regional Committee in September 2015 in Vilnius, Lithuania.

The meeting in Ashgabat, where 35 European countries were represented along with 17 experts and NGOs, offered an exchange of the latest developments in tobacco control in the European countries and discussions on the way forward to reaching the global voluntary target of a 30% relative reduction in tobacco use prevalence by 2025.

The European Ombudsman recommends proactive transparency policies in interactions with the tobacco industry
The European Ombudsman stakeholder seminar on Improving Transparency in Tobacco Lobbying was held on 27 April 2016 in Brussels in the context of the Ombudsman's recommendation to the European Commission to follow the proactive transparency policies of DG SANTE and to disclose details of all meetings with tobacco lobbyists or their legal representatives.

Ms Emily O'Reilly noted her surprise that the Commission had rejected her recommendation and hoped that the support of the European Parliament, the EU Health Commissioner and participants at the seminar would lead the Commission to follow her Recommendation.

Obama Administration launches new initiative against e-cigarettes

On May 5, the US Obama Administration issued a rule establishing FDA oversight of electronic cigarettes, cigars, hookah and other previously unregulated tobacco products.

The rule applies public health protections to all tobacco products, including health warnings, a national prohibition on sales to minors and rules to prohibit manufacturers from making unproven health claims. The FDA also announced plans to extend the current federal ban on candy/fruit-flavoured cigarettes to flavoured cigars, although this will require additional regulations.
Imperial Tobacco challenges French rules on plain packaging

A subsidiary of Imperial Tobacco announced on Tuesday 10 May 2016 that it challenges the French rules mandating plain packaging to the Conseil D’Etat, France’s top administrative court, claiming that plain packaging violates intellectual property rights.

The regulations, adopted on 21 March in the French official journal, require tobacco firms to comply with new packaging rules by 1 January 2017. The subsidiary in question claims that the French version of plain packaging goes against all the objectives of the European harmonisation. Health Minister Marisol Touraine notes however that the rules on plain packaging will enter into force as planned on 21 May 2016.

The EU project SILNE-R works on Tackling socio-economic inequalities in smoking, learning from natural experiments by time trend analyses and cross-national comparisons. Read more about the project on the newly launched SILNE-R website.

Ex-post evaluation of the Second Health Programme 2008-2013

On 10 May 2016 the Commission published its ex-post evaluation report assessing the main outcomes of the Commission's Second Health Programme, which ran from 2008 to 2013 with a budget of € 321.5 million. The evaluation underlined the need for improvement in transforming outputs into results and tangible impacts and to ensure the dissemination of action outputs and reach to key stakeholders. The recommendations will be taken into account to improve the implementation of the Third Health Programme (2014-2020).
